These Terms and Conditions ("Terms") govern your use of Luumer (the "Service"), available at www.luumer.com.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service.

By registering, you confirm that:

• The information you provide is accurate and complete.

• You will keep your login credentials secure.

• You are responsible for all activity under your account.

You may delete your account at any time via your account settings. Upon deletion, your account data (including plans, chat history, uploaded files, and associated records) will be permanently removed from active systems, subject to legal or technical retention requirements.

2. Nature of the Service

Luumer is an AI-powered planning and productivity tool that generates structured plans based on user-provided information.

The Service:

• Generates AI-created plans and milestones

• Stores user plans and chat history

• Allows document uploads (maximum 55MB per file)

• Allows limited sharing of plan pages via private link (when enabled)

The Service is currently provided free of charge. Paid plans or premium features may be introduced in the future.

3. AI-Generated Content & Disclaimer

The Service uses artificial intelligence provided by OpenAI and content moderation and safety systems provided by Anthropic, and authentication services provided by Clerk.You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, misleading, or inappropriate.

• Outputs are generated automatically and may contain errors.

• The Service does not guarantee any results.

• The Service is provided for informational and general guidance purposes only.

We may process and analyse user inputs and outputs using automated systems to detect harmful, unlawful, or abusive use of the Service and to maintain safety and compliance.

The Service does not provide:

• Medical advice

• Mental health advice

• Legal advice

• Financial advice

• Professional coaching

• Crisis support

You must not rely on the Service as a substitute for professional advice.

If you are experiencing a medical emergency or mental health crisis, including thoughts of self-harm, you must contact emergency services or a qualified professional immediately.

We do not accept responsibility for how users interpret, modify, or act upon AI-generated outputs.

We do not assume any duty of care or professional obligation toward users of the Service.

While we may implement systems to detect misuse, we do not guarantee that all harmful or unlawful activity will be identified or prevented.

You use the Service entirely at your own risk.

4. No Guarantee of Outcomes

We make no representation or warranty that:

• You will achieve any goal

• You will win any competition

• You will improve your health or fitness

• You will increase revenue or financial performance

• You will achieve measurable success of any kind

All plans are suggestions only. You are solely responsible for how you implement or interpret them.

5. Acceptable Use

You agree not to use the Service to:

• Plan or commit illegal activities

• Generate harmful or unlawful content

• Circumvent AI safeguards

• Upload infringing, unlawful, or malicious files

• Attempt to exploit or reverse engineer the Service

• Attempt to bypass, interfere with, or undermine safety, moderation, or monitoring systems

• Use the Service in a way that may expose us to legal or regulatory risk

We reserve the right to suspend or terminate accounts without notice if we believe these Terms have been violated.

6. File Uploads

You may upload files up to 55MB per file.

Accepted file categories include:

• Images

• Videos

• PDFs

• Word documents

• Spreadsheets

• CSV files

• Plain text files

• ZIP/RAR archives

Files outside permitted types are rejected.

Uploaded files:

• Are not publicly viewable

• Are not indexed by search engines

• Are not scanned for malware or viruses

You are solely responsible for the content you upload. We are not liable for damage caused by files uploaded by users.

You upload files at your own risk.

7. User Content & Licence

You retain ownership of content you input or upload.

By using the Service, you grant a limited licence to:

• Process your data

• Generate AI outputs

• Store and display plans within your account

• Enable sharing features when activated by you

You are responsible for ensuring that your content does not infringe third-party rights.

8. Data & Privacy

The Service stores:

• User account information

• AI-generated plans

• Chat history

• Task progress data

• Action history for undo functionality

• IP address, country, and login/session data for security and abuse prevention purposes

• User preferences and settings (such as availability, scheduling, and notification preferences)

We may monitor usage patterns, inputs, and interactions with the Service to detect misuse, enforce safeguards, and maintain system security and integrity.

The Service is hosted on Replit and uses a PostgreSQL database backed by Neon. AI processing is performed via OpenAI and moderation/safety processing is performed via Anthropic. Authentication is handled by Clerk.

The Service is available worldwide and data may be processed outside the United Kingdom.

All user data is deleted upon account deletion, subject to legal or technical retention requirements.

9. Account Termination

We may suspend, restrict, or terminate your account at our discretion, including without notice, if:

• You breach these Terms

• You misuse the Service

• We are required to do so by law

You may stop using the Service at any time.

10. Limitation of Liability

To the fullest extent permitted under the laws of England and Wales:

Our total liability to you for any claims arising out of or relating to the Service shall not exceed £100.

We are not liable for:

• Failure to achieve goals

• Business losses

• Financial losses

• Health consequences

• Emotional distress

• Indirect or consequential losses

• Loss of data

• Loss of opportunity

We are not responsible for any actions taken based on AI-generated outputs, including personal, professional, financial, health, or legal decisions.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under UK law.

11. Indemnification

You agree to indemnify and hold harmless OLHA ZAPLATYNSKA from any claims, damages, liabilities, costs, or expenses arising from:

• Your misuse of the Service

• Your violation of these Terms

• Your unlawful conduct

• Content you upload or generate

12. Intellectual Property

All intellectual property rights in the Service, including its design, branding, code, and functionality, are owned by OLHA ZAPLATYNSKA.

You may not copy, reproduce, distribute, modify, or reverse engineer any part of the Service without permission.

13. Future Paid Features

We reserve the right to introduce paid plans, subscriptions (monthly or annual), free trials, and other premium features in the future. Additional terms may apply at that time.

14. Availability

The Service is provided "as is" and "as available".

We do not guarantee uninterrupted access or error-free operation.

We may modify, update, or remove features of the Service at any time without prior notice.

15. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Security

While we implement reasonable technical and organisational measures to protect the Service and user data, we do not guarantee that the Service will be secure, uninterrupted, or free from unauthorised access, data breaches, or cyber threats.

You acknowledge that any data transmitted or stored using the Service is done at your own risk.
